نقش و مسئولیت بین‌المللی دولت‌ها در برابر خسارت‌های زیست‌محیطی

از مهم ترین ابزارهایی که میتوان از محیط زیست در عرصه نظام بین الملل حفاظت کرد ایجاد مسئولیت بین المللی برای دولتهاست. این مسئولیت تعهدی است که در صورت نقض آن جبران خسارت را در پی خواهد داشت. از اینرو این مقاله پیش رو با روش توصیفی تحلیلی و منابع کتابخانه ای تلاش دارد به مسئولیت دولتها در نظام بین الملل و نحوه جبران خسارت های زیست محیطی در نظام بین الملل بپردازد. در این راستا با وجود کنوانسیون ها و اعلامیه های بین المللی برای جبران خسارت زیست محیطی، همانند «سطح خسارت» ، «ماهیت» ، «محدوده خسارت» و «مسئولیت بین المللی» اما همچنان پیشگیری ،نحوه ارزیابی و جبران خسارات های زیست محیطی مانند اعاده به وضع سابق، و پرداخت غرامت و سایر روش‌ها هنوز با نارسایی‌هایی مواجه میباشد از این روی طرح مسئولیت بین المللی و ضمانت اجرایی براي جلوگیري از خسارات وارد بر محیط زیست با دامنه فراگیر بین‌المللی است که می‌تواند ساز و کاري مفید در راستاي بهبود حقوق بین‌الملل محیط زیست باشد.
