صیانت از قانون اساسی در نظام حقوقی فرانسه

صیانت از قانون اساسی در هر نظام حقوقی یکی از اصول بنیادین در حفظ ثبات و مشروعیت ساختار حکومتی است. در نظام حقوقی فرانسه، قانون اساسی جایگاه ویژه‌ای دارد و سازوکارهای مختلفی برای تضمین برتری و اجرای آن پیش‌بینی شده است. این پژوهش به بررسی نحوه صیانت از قانون اساسی در فرانسه می‌پردازد و تلاش دارد تا به این سوال پاسخ دهد که چگونه در حقوق فرانسه از قانون اساسی حفاظت می‌شود. مقاله حاضر با استفاده از روش تبیینی و به شیوه کتابخانه‌ای گردآوری شده است. در این تحقیق، به نقش شورای قانون اساسی در نظارت بر همخوانی قوانین با اصول قانون اساسی، همچنین سازوکارهای قانونی و نهادهای مختلف مسئول در این زمینه پرداخته شده است. نتایج این پژوهش نشان می‌دهد که در نظام حقوقی فرانسه، صیانت از قانون اساسی از طریق نظارت دقیق، تفسیر اصول قانون اساسی و جلوگیری از هرگونه تخلف یا سوءاستفاده از آن، به‌طور مؤثری تضمین می‌شود. یافته ها نشان می‌دهد که در فرانسه، صیانت از قانون اساسی بر عهده شورای قانون اساسی است که وظیفه اصلی آن نظارت بر تطابق قوانین با قانون اساسی است. علاوه بر این، شورا در برخی موارد دیگر مانند نظارت بر رفراندوم‌ها، انتخابات، و اقدامات رئیس‌جمهور در مواقع بحران نیز مداخله می‌کند.

The protection of the Constitution in any legal system is a fundamental principle for maintaining the stability and legitimacy of the governmental structure. In the French legal system, the Constitution holds a special position, and various mechanisms have been put in place to ensure its supremacy and implementation. This research examines how the Constitution is protected in France and seeks to answer the question of how the Constitution is safeguarded in French law. The present paper has been compiled using an explanatory method and library-based research. This study explores the role of the Constitutional Council in overseeing the alignment of laws with constitutional principles, as well as the legal mechanisms and various institutions responsible for this process. The findings of this research indicate that in the French legal system, the protection of the Constitution is effectively ensured through careful oversight, the interpretation of constitutional principles, and the prevention of any violation or misuse of those principles. The results show that in France, the protection of the Constitution is primarily the responsibility of the Constitutional Council, whose main task is to monitor the compatibility of laws with the Constitution. Additionally, the Council intervenes in other areas, such as overseeing referendums, elections, and the actions of the President during times of crisis.
